Terms of Use

1. Who you are dealing with

These Terms of Use (the "Terms") are an agreement between you and TTP Tech sp. z o.o. (TTP TECH SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ), a limited liability company with its registered office at ul. Floriańska 6 lok. 02, 03-707 Warsaw, Poland, KRS 0001200085, NIP 1133182288, REGON 542997692 ("TTP Tech", "we", "us"). They govern your use of the Groewy mobile application for iOS and Android (the "App"), the website groewy.com (the "Website"), and the content and features they provide (together, the "Service").

By creating an account or using the Service you accept these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal data and forms part of these Terms.

2. Eligibility

You must be at least 18 years old and have full legal capacity to use the Service. By using it you confirm that this is the case and that any information you give us is accurate and kept up to date.

3. What Groewy is, and what it is not

AI-generated content can be incomplete, outdated or wrong. Market data may be delayed or contain errors. You alone decide whether and how to act on anything the Service shows you, and you should consult a licensed professional before making investment, tax or legal decisions. Investing involves risk, including the possible loss of the money you invest.

4. Your account

You need an account to use the App. Keep your login details confidential and tell us at team@groewy.com immediately if you suspect unauthorised use. You are responsible for activity under your account unless it results from our failure to secure the Service. One person may hold one account, and accounts may not be shared or transferred.

5. Free features and paid subscriptions

Parts of the Service are free. Additional features are available through a paid subscription ("Groewy Premium"), purchased through the Apple App Store or Google Play (each a "Store"). The price, billing period and included features are shown in the App before you buy.

• Automatic renewal. Subscriptions renew automatically at the end of each billing period at the price shown at purchase, unless you cancel at least 24 hours before the period ends.
• Managing and cancelling. You manage and cancel subscriptions in your Store account settings (Apple ID subscriptions, or Google Play subscriptions), not in the App. Cancellation takes effect at the end of the current period; you keep access until then.
• Payments and refunds. Payment is collected by the Store under its terms. Refund requests are handled by the Store under its policies, subject to your statutory rights described in section 6.
• Price changes. If we change a subscription price, you will be notified in advance through the Store or the App and the new price will apply only from the next renewal after you have had the opportunity to cancel.
• Trials and offers. Where a free trial or introductory price is offered, its length and the price that applies afterwards are shown before you start. A trial converts to a paid subscription unless cancelled before it ends.

6. Consumer right of withdrawal

If you are a consumer in the European Union, you have the right to withdraw from a distance contract within 14 days without giving a reason. Because Groewy Premium is digital content delivered immediately, you will be asked at purchase to agree that delivery begins right away and to acknowledge that you lose the right of withdrawal once it has begun. Where you make a purchase through a Store, the Store's own withdrawal and refund process applies in addition. Nothing in these Terms limits the rights you have under the Polish Act on Consumer Rights of 30 May 2014 or other mandatory law of the country where you live.

7. Acceptable use

You agree not to:

• use the Service for anything unlawful, or to give investment advice to others as if it came from a licensed source;
• copy, scrape, reverse-engineer, decompile or otherwise try to extract the source code, models or data behind the Service, except where the law expressly allows it;
• interfere with the Service's security or operation, probe or test its vulnerabilities without our written permission, or use automated tools to access it;
• upload malicious code, false information or content that infringes someone else's rights;
• resell, sublicense or commercially exploit the Service or its content without our written permission.

8. Intellectual property and licence

The Service, including its software, design, text, graphics, models and the Groewy name and logo, belongs to TTP Tech or its licensors and is protected by copyright, trademark and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use, in accordance with these Terms and the applicable Store rules.

You keep ownership of the information you enter into the Service. You grant us a licence to store, process and display it in order to provide the Service to you, and to use it in aggregated or anonymised form to improve the Service. You may not submit content you have no right to share.

9. Third-party services and app stores

The Service relies on third parties, including the Stores, hosting providers and market-data providers. We are not responsible for their services or content, and your use of them is governed by their own terms.

If you downloaded the App from the Apple App Store, you also agree that: these Terms are between you and TTP Tech only, not Apple; Apple has no obligation to provide maintenance or support for the App; to the extent permitted by law, Apple has no warranty obligation for the App and any claim relating to the App, including product liability, legal compliance and intellectual property claims, is our responsibility and not Apple's; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's standard Licensed Application End User Licence Agreement applies where it does not conflict with these Terms.

10. Availability and changes to the Service

We work to keep the Service available but cannot guarantee uninterrupted access. We may change, suspend or discontinue features, and we may perform maintenance, with reasonable notice where practicable. If we discontinue a paid feature you have already paid for, we will refund the unused part of the current period or offer an equivalent feature.

11. Warranties and disclaimers

If you are a consumer, you are entitled to digital content and services that conform to the contract, as provided by Polish law implementing Directive (EU) 2019/770, and nothing in this section limits those rights. Beyond that, and to the extent the law allows, the Service is provided "as is" and we make no promises that AI-generated plans, market data or other content are accurate, complete, timely or suitable for your situation.

12. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury, for damage caused intentionally, or for anything that cannot be excluded under mandatory law, including consumer protection law. Subject to that, we are not liable for investment losses or other financial decisions you make on the basis of the Service, for indirect or consequential losses, or for loss of profits, data or goodwill. For users who are not consumers, our total liability arising from the Service in any 12-month period is limited to the amount you paid us for the Service in that period.

13. Termination

You may stop using the Service and delete your account at any time in the App (Settings → Account → Delete account) or by writing to us. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service, giving you reasonable notice where the circumstances allow. On termination your licence ends and we delete your data as described in the Privacy Policy; sections that by their nature should survive, including 8, 9, 12 and 15, remain in force.

14. Changes to these Terms

We may amend these Terms for valid reasons, such as changes in the law, in the Service or in our business. We will notify you in the App or by email at least 14 days before material changes take effect. If you do not accept the new Terms you may terminate your account before they apply; continued use after that date means you accept them. The current version is always at groewy.com/terms.

15. Complaints and dispute resolution

You can submit a complaint about the Service to team@groewy.com or by post to our registered office. Please describe the problem and your account email. We reply within 14 days of receiving the complaint.

If you are a consumer in the EU, you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, and in Poland you may seek free help from a municipal or district consumer ombudsman (rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa) for out-of-court resolution. We will take part in such proceedings where the law requires or where we agree to in a particular case.

16. Governing law and courts

These Terms are governed by the law of Poland. If you are a consumer living in another EU country, you also enjoy the mandatory consumer protections of that country, and you may bring proceedings in its courts. For users who are not consumers, the courts of Warsaw, Poland have exclusive jurisdiction.
